The Medicaid Quality Care Act directs the federal health department to set rules so that states overseeing Medicaid must develop and enforce quality‑control plans for care delivered by providers located outside the state. The goal is to improve oversight of out‑of‑state services for people enrolled in Medicaid, affecting state Medicaid agencies, out‑of‑state health providers, and Medicaid beneficiaries.

Key Provisions

  • Within one year of the law’s enactment, the Secretary of Health and Human Services must issue regulations that require each Medicaid‑participating state to create a written plan for quality control and oversight of medical services provided to its Medicaid enrollees by out‑of‑state providers.
  • States must implement the written plan (or obtain a waiver) to monitor and ensure the quality of out‑of‑state Medicaid care.
