No Budget, No Pay Act

Introduced January 3, 2017

AI-Generated Summary

Updated April 15, 2026 at 10:53 AM UTC

The No Budget, No Pay Act would withhold salary for Senators and Representatives after October 1 of any fiscal year in which Congress fails to adopt a budget resolution and pass all regular appropriations bills. Pay would resume only once both requirements are met, and the withheld pay would not be paid later. The bill assigns the Senate and House budget and appropriations committee chairs the job of determining and certifying the freeze period each year.

Key Provisions

  • If Congress has not passed a budget resolution and all regular appropriations bills before October 1 of a fiscal year, members of Congress stop receiving pay after that date until both are approved.
  • The Senate and House budget and appropriations committee chairs must certify each year whether the pay freeze applies and for how many days, after a request from the Senate secretary or House chief administrative officer.
  • No money can be taken from the Treasury to pay members during the freeze, and any pay that would have been earned during that period cannot be paid retroactively.
  • The law takes effect on February 1, 2019.
