The bill updates the Federal Power Act to give longer time frames and more flexibility for hydropower projects. It lengthens the initial preliminary permit period from three to four years and allows a single extension of up to four additional years, with a possible extra permit if extraordinary circumstances exist. It also extends the construction deadline for projects by up to eight additional years and postpones when annual charges must be paid until after the construction deadline or any extension.

Key Provisions

  • Increase the preliminary permit term to 4 years and allow one extension of up to 4 additional years; permittees may receive an additional permit if extraordinary circumstances warrant it.
  • Extend the construction deadline for project works by allowing up to 8 additional years beyond the original limit.
  • Delay the start of annual charge payments for licensees or exempt parties until the later of the required construction start date or any granted extension.
