The No Budget, No Pay Act would withhold salary from Senators and Representatives after October 1 of any fiscal year in which Congress fails to pass a budget resolution and all regular appropriations bills. Pay would resume only once those actions are completed, and members could not receive back pay for the withheld period. The bill sets up a certification process by the budget and appropriations committees to determine and certify the pay‑freeze each year.

Key Provisions

  • If Congress has not adopted a budget resolution and passed all regular appropriations bills before October 1 of a fiscal year, members of Congress stop receiving pay after that date until both are approved.
  • Members cannot be paid retroactively for any days they were unpaid under this rule.
  • The Senate and House budget and appropriations committee chairs must certify each year, on October 1, whether the pay‑freeze applies and for how many days, after a request from the Senate secretary or House chief administrative officer.
  • The law takes effect on February 1, 2021.
