The bill changes the tax rules for distilled spirits imported into the United States from Puerto Rico and the Virgin Islands. It removes a previous cap that limited how much of the tax could be “covered over” (i.e., transferred) to the local treasuries, and it directs a portion of the rum tax to be sent to the Puerto Rico Conservation Trust Fund. The changes apply to spirits brought in after Dec. 31, 2018 and affect the U.S. Treasury, Puerto Rico’s treasury, and the Conservation Trust Fund.

Key Provisions

  • Repeals the limitation on the amount of distilled‑spirits tax that can be covered over to Puerto Rico and the Virgin Islands by deleting subsection (f) of §7652 and renumbering the remaining subsections.
  • Requires that, for rum taxes, $0.46 per proof gallon of the covered‑over amount be transferred to the Puerto Rico Conservation Trust Fund, treating that transfer as if it were covered over to Puerto Rico’s treasury.
  • Sets the effective date of both changes to apply to distilled spirits (including rum) imported after December 31, 2018.
