This bill changes the Medicare Part B late‑enrollment penalty. It caps the penalty at 15 percent of the monthly premium and applies it for a period equal to twice the length of time a person was without Part B. It also says that time spent on COBRA, retiree health plans, or VA health coverage should not count toward the penalty, and it expands the special enrollment window for people whose COBRA or retiree coverage ends.

Key Provisions

  • Limits the late‑enrollment penalty to 15 percent of the monthly premium and applies it for twice the number of months the person was not enrolled.
  • Excludes any months covered by COBRA, retiree health plans, or VA health benefits from counting toward the penalty.
  • Removes the requirement that a person be currently employed (or a spouse be employed) to qualify for a special enrollment period after COBRA or retiree coverage ends.
  • Sets the changes to take effect for premiums beginning after a 90‑day period following the bill’s enactment.
