Updated April 14, 2026 at 8:19 AM UTC

The bill changes U.S. law to give the Customs and Border Protection commissioner a role in national‑security reviews of wind turbine projects located in U.S. waters that share a border with Canada. It defines such projects as “covered wind turbines” and mandates that the Department of Defense consult with CBP on these projects. The changes affect federal agencies handling defense, transportation, and border security, as well as developers of offshore wind turbines near the Canadian border.

Key Provisions

  • Amends the law so that the Commissioner of U.S. Customs and Border Protection (CBP) is added to the list of officials who must make national‑security determinations for wind turbines that would be built in U.S. waters bordering Canada.
  • Creates a definition of “covered wind turbine” as any wind turbine proposed for construction in a U.S. body of water that borders Canada.
  • Requires the Secretary of Defense to consult with the CBP Commissioner when reviewing energy projects (including wind turbines) filed with the Secretary of Transportation that fall under this definition.
