Sponsored by Joe NeguseRep. Joe Neguse (D-CO)
Introduced May 27, 2020

AI-Generated Summary

Updated April 14, 2026 at 12:40 PM UTC

The bill makes permanent the Antitrust Criminal Penalty Enhancement and Reform Act of 2004, which boosts criminal penalties and offers cooperation incentives for antitrust violations. By removing the law’s built‑in expiration, the enhanced penalties and cooperation provisions will continue indefinitely, affecting companies and individuals accused of price‑fixing, bid‑rigging, or market‑allocation schemes, as well as the Justice Department and private parties pursuing antitrust cases.

Key Provisions

  • Repeals the sunset provision (Section 211) of the 2004 Antitrust Criminal Penalty Enhancement and Reform Act, making its provisions permanent.
  • Amends Section 212 of the same act by deleting paragraph (6) and renumbering the former paragraph (7) as the new paragraph (6) to align with the repeal.
