Cooperate with Law Enforcement Agencies and Watch Act of 2019

Introduced January 24, 2019

AI-Generated Summary

Updated April 14, 2026 at 12:59 AM UTC

The Cooperate with Law Enforcement Agencies and Watch Act of 2019 creates a legal safe harbor for banks and other financial institutions when a federal, state, tribal, or local law‑enforcement agency asks them in writing to keep a customer's account or transaction open. The law shields the institution from liability and from any adverse regulatory action for complying with that request, while still requiring the institution to verify the request’s validity and to meet existing reporting duties such as filing suspicious‑activity reports. The rule applies to all financial institutions that receive such written requests.

Key Provisions

  • Adds a new Section 5333 to 31 U.S.C. § 5333, establishing a safe harbor for financial institutions that keep an account or transaction open at the written request of law‑enforcement.
  • Financial institutions are not liable and cannot be subject to adverse supervisory action for maintaining the account or transaction as requested.
  • Law‑enforcement agencies may still verify the authenticity of the written request with the agency that issued it.
  • Institutions must continue to comply with all reporting requirements, including filing suspicious‑activity reports under the Bank Secrecy Act.
  • Each written request must include a termination date after which the requirement to keep the account or transaction open ends.
