Paycheck Protection Program Flexibility Act of 2020

Introduced May 21, 2020

AI-Generated Summary

Updated April 14, 2026 at 12:34 PM UTC

The Paycheck Protection Program Flexibility Act of 2020 updates PPP rules to give small businesses more leeway in loan forgiveness and repayment. It extends the period during which payroll costs count toward forgiveness, lets borrowers defer payroll taxes, and changes loan maturity requirements. The changes apply to any PPP loan made under the Small Business Act or the CARES Act.

Key Provisions

  • Extend the PPP covered period for forgiveness from June 30, 2020 to December 31, 2020, and allow an additional 8‑week extension for loans made before the law’s enactment.
  • Set a minimum loan maturity of five years before the maximum maturity can apply.
  • Allow forgiveness to be calculated without reducing employee counts if the business cannot rehire or return to pre‑COVID activity levels.
  • Permit borrowers to defer employer payroll tax payments on forgiven loan amounts.
  • Prohibit the administrator from limiting the non‑payroll portion of a forgivable loan.
