Protecting Americans with Pre-existing Conditions Act of 2019

Introduced February 13, 2019

AI-Generated Summary

Updated April 14, 2026 at 1:45 AM UTC

The Protecting Americans with Pre‑existing Conditions Act of 2019 blocks the Department of Health and Human Services and the Treasury from using or issuing guidance that would allow states to obtain “State Relief and Empowerment Waivers” under the Affordable Care Act. By preventing that guidance from taking effect, the bill stops states from using these waivers to modify ACA requirements, which could affect insurance coverage and protections for people with pre‑existing conditions.

Key Provisions

  • Prohibits the HHS and Treasury secretaries from implementing, enforcing, or giving effect to the October 24, 2018 guidance titled “State Relief and Empowerment Waivers.”
  • Bars the secretaries from issuing any substantially similar guidance or rule on state innovation waivers.
  • Sets the effective date of these prohibitions as April 1, 2019.
