The CARING for Social Determinants Act of 2021 directs the Department of Health and Human Services to give states clear guidance on how to address social determinants of health through Medicaid and the Children’s Health Insurance Program. It requires the guidance to be updated at least every three years and is aimed at state Medicaid agencies, managed‑care organizations, and the children and families they serve.

Key Provisions

  • The HHS Secretary must update the State Health Office letter 21‑001 within three years of enactment and at least every three years thereafter, providing refreshed guidance on social‑determinant strategies for Medicaid and CHIP.
  • The guidance must tell state Medicaid agencies how to use existing statutory authorities (title XIX, title XXI, or section 1115 waivers) to address social determinants, including specific approaches for children on medical assistance.
  • It must include instructions for states to encourage and incentivize managed‑care entities to incorporate social‑determinant goals in their contracts.
  • The update must offer examples from states that illustrate how they are integrating social‑determinant strategies and payment models into Medicaid and CHIP services.
