Supporting Essential Workers in Retirement Act

Introduced February 16, 2022

AI-Generated Summary

Updated February 8, 2026 at 9:28 AM UTC

The Supporting Essential Workers in Retirement Act would let people who are already receiving Social Security benefits and who earned extra premium pay for essential work during the COVID‑19 emergency period keep that extra pay from counting toward the earnings limit that can reduce their benefits. It applies to semi‑retired or retired workers who performed essential jobs and received premium pay, as well as to the Social Security Administration and employers who must verify and report the pay.

Key Provisions

  • Defines the COVID‑19 emergency period as March 13, 2020 through December 31, 2021 and defines “essential work” as work needed to keep critical infrastructure operating during that time.
  • Defines “premium pay” as higher pay for essential work or extra hours that raise a worker’s average weekly compensation compared to pre‑pandemic levels.
  • Excludes any premium pay earned during the emergency period from the Social Security earnings test that determines excess earnings for benefit reductions.
  • Requires the SSA, within 30 days of enactment, to issue guidance for employers to verify premium pay using Form SSA‑131.
  • Requires employers, within 90 days of the SSA guidance, to notify eligible employees that they can elect to have their premium pay excluded from the earnings test.
