Guidance Clarity Act of 2021

Introduced March 2, 2021

AI-Generated Summary

Updated February 7, 2026 at 11:36 PM UTC

The Guidance Clarity Act of 2021 requires every federal agency that issues guidance under the existing administrative procedure to add a clear statement on the first page of each guidance document. The statement tells readers that the guidance does not have the force of law and does not bind the public or the agency, but merely explains existing legal or policy requirements. The law applies to all agencies covered by the definition in Title 5, and the Office of Management and Budget must issue implementing guidance within 90 days of the Act’s enactment.

Key Provisions

  • Agencies must include a “guidance clarity statement” on the first page of any guidance issued after the OMB’s implementation guidance is released.
  • The required statement must read: “The contents of this document do not have the force and effect of law and do not, of themselves, bind the public or the agency. This document is intended only to provide clarity to the public regarding existing requirements under the law or agency policies.”
  • The Director of the Office of Management and Budget must publish guidance on how to implement this requirement no later than 90 days after the Act becomes law.
