The Military Spouse Hiring Act changes the tax code so that employers who hire spouses of service members can claim the Work Opportunity Tax Credit. It adds a new category of “qualified military spouse” to the list of eligible workers for the credit. The change applies to wages paid after the law takes effect and to employees hired after that date, helping military families and encouraging employers to hire them.

Key Provisions

  • Adds “qualified military spouse” as an eligible group for the Work Opportunity Tax Credit under section 51(d) of the Internal Revenue Code
  • Defines a qualified military spouse as any individual certified by the designated local agency as the spouse of a member of the U.S. Armed Forces at the time of hiring
  • Specifies that the credit applies to amounts paid after enactment for employees who begin work after the law takes effect
