Social Security Fairness Act

Introduced March 1, 2023

AI-Generated Summary

Updated January 20, 2026 at 4:09 AM UTC

The Social Security Fairness Act would eliminate two rules that reduce Social Security benefits for people who also receive a government pension. It repeals the Government Pension Offset, which can cut spousal or survivor benefits, and the Windfall Elimination Provision, which can lower retirement benefits for those with non‑Social Security pensions. The changes would apply to anyone receiving Social Security benefits who also has a government pension, starting after December 2023.

Key Provisions

  • Repeals the Government Pension Offset provision by removing the relevant paragraph from the Social Security Act and updating related sections for consistency.
  • Repeals the Windfall Elimination Provision by striking the specified paragraphs from Section 215 of the Social Security Act and making conforming amendments to related sections.
  • Sets the effective date so that the changes apply to monthly insurance benefits payable after December 2023, and directs the Social Security Commissioner to adjust benefit amounts as needed.
