The BAD DEAL Act of 2026 repeals Section 338 of the Tariff Act of 1930 and cancels any presidential proclamations that imposed tariffs or duties under that authority. It also requires the President to arrange refunds for any tariffs that were collected because of those proclamations. The bill mainly affects importers, U.S. businesses that paid those duties, and the federal agencies that enforce them.

Key Provisions

  • Repeals Section 338 of the Tariff Act of 1930, removing the legal basis for certain trade‑related tariffs.
  • Nullifies any presidential proclamations that were issued under Section 338, making them have no legal effect.
  • Mandates that the President take steps to refund all tariffs or duties collected under those now‑invalid proclamations, even if they were paid before the law’s enactment.
