American Cargo for American Ships Act

Introduced March 11, 2025

AI-Generated Summary

Updated November 24, 2025 at 2:01 AM UTC

The American Cargo for American Ships Act changes U.S. maritime law to make sure that any cargo bought, contracted for, or financed by the Department of Transportation is shipped on privately‑owned U.S.‑flag commercial vessels whenever those vessels are available at reasonable rates. It directs the Secretary of Transportation to enforce a 100 % tonnage requirement for such cargo, with attention to fair geographic participation. The bill mainly affects DOT‑funded shipments and U.S. commercial shipping companies.

Key Provisions

  • Amends 46 U.S.C. § 55305 to require that any cargo the Department of Transportation procures, contracts for, or finances with federal funds be transported on privately‑owned commercial vessels that are U.S.‑flagged.
  • The Secretary of Transportation (or the financing recipient) must take practical steps to ensure that 100 % of the gross tonnage of such cargo—calculated separately for dry bulk carriers, dry cargo liners, and tankers—is moved on U.S. vessels, provided those vessels are available at fair and reasonable commercial rates.
  • The rule also calls for a fair and reasonable geographic distribution of U.S. vessel participation in carrying the cargo.
  • The amendment adds an “Exception” clause that applies when the Department of Transportation obtains or finances equipment, materials, or commodities, specifying the above requirements.
