Financial Stability Oversight Council Improvement Act of 2025

Introduced June 3, 2025

AI-Generated Summary

Updated February 13, 2026 at 4:11 AM UTC

The Financial Stability Oversight Council Improvement Act of 2025 changes the 2010 Financial Stability Act so that the Council must first explore alternative actions and confirm they are insufficient before deciding to put a U.S. non‑bank financial company under Federal Reserve supervision. This adds an extra review step involving the company and its primary regulator, aiming to ensure that supervision is used only when other measures cannot mitigate financial‑stability risks. The bill mainly affects how the Council handles oversight of non‑bank financial firms.

Key Provisions

  • Adds a new step (paragraph 3) requiring the Financial Stability Oversight Council to first consult with the non‑bank financial company and its primary regulator and determine that no other action—such as applying stricter standards, safeguards, or a company‑submitted remediation plan—would adequately address the risk before the Council can vote to place the company under Federal Reserve supervision.
  • Amends the language in the council’s authority to reference the new paragraph 3 and updates a cross‑reference in subsection (f)(1) to point to the new provisions.
