Haiti Economic Lift Program Extension Act

Introduced December 9, 2025

AI-Generated Summary

Updated January 15, 2026 at 4:11 AM UTC

The Haiti Economic Lift Program Extension Act keeps Haiti’s duty‑free treatment for certain U.S. imports in place and extends it through Dec. 31, 2028. It updates the percentage and volume limits for apparel, restores eligibility for some Haitian products that lost preferential status, and allows retroactive relief for recent import entries.

Key Provisions

  • Amends the Caribbean Basin Economic Recovery Act to set the “applicable percentage” at 60% or more and caps preferential treatment for apparel at 1.25% of total U.S. apparel imports each year.
  • Changes the language so the extension can apply in any of the succeeding one‑year periods, not automatically for all 16 periods.
  • Sets the termination date for Haiti’s duty‑free treatment as Dec. 31, 2028.
  • Requires the President to issue a proclamation updating the Harmonized Tariff Schedule to restore eligibility for Haitian articles that were eligible in 2006 but later lost that status.
  • Provides retroactive application: entries of Haitian goods made after Sept. 30, 2025 but before the law’s enactment can be liquidated or reliquidated as if the law were already in effect, if a request is filed within 180 days; any U.S. payments due must be made within 90 days.
