Ensuring Children Receive Support Act

Introduced December 18, 2025

AI-Generated Summary

Updated April 28, 2026 at 6:20 AM UTC

The Ensuring Children Receive Support Act would make a U.S. passport revocable for anyone who owes more than $2,500 in child support, once the Health and Human Services Secretary certifies the debt. It is intended to increase pressure on non‑paying parents to meet their obligations. The law affects individuals with child‑support arrears, the State Department, and the HHS Secretary.

Key Provisions

  • The Secretary of State must revoke any U.S. passport when HHS certifies that the holder has child‑support arrears over $2,500.
  • The Social Security Act is amended to require revocation (removing language that allowed only restriction or limitation) and to require the individual be notified before the action.
  • If the person is abroad and needs to return to the United States for an emergency, the State Department may issue a limited‑duration temporary passport for that purpose only.
  • The new revocation rules take effect on October 1, 2026.
