Critical Mineral Consistency Act of 2025

Introduced January 28, 2025

AI-Generated Summary

Updated March 6, 2026 at 4:13 AM UTC

The Critical Mineral Consistency Act of 2025 updates the Energy Act of 2020 to create a single, unified list of both critical minerals and critical materials. It requires the Secretary of Energy to publish this combined list soon after the law takes effect and to keep it current as designations change. Federal agencies that rely on the definitions of critical minerals or materials must use the most recent version of this list when administering related programs.

Key Provisions

  • Amends the Energy Act to insert the phrase “minerals or materials” after “critical,” ensuring the terminology covers both types.
  • Adds a new subsection that directs the Secretary of Energy to publish a combined Critical Minerals and Materials List within 45 days of the law’s enactment.
  • The list must include any mineral designated as critical and any non‑fuel mineral, element, substance, or material deemed a critical material at that time.
  • Requires the Secretary to update the list within 45 days whenever a critical mineral or material designation is changed, and to coordinate updates with the Secretary of Energy.
  • Mandates that the Secretary, the Secretary of Energy, and heads of other federal agencies use the most recent list for administering programs that involve critical minerals or materials.
