Updated April 13, 2026 at 2:08 AM UTC

The CFTC Proprietary Information Act of 2026 amends the Commodity Exchange Act to require the Commodity Futures Trading Commission (CFTC) to create rules that protect any proprietary information it receives. The new rules will set standards for how the CFTC requests, safeguards, limits access to, and prevents unlawful use or disclosure of such information, and they will also govern how the CFTC can share the information with other government agencies.

Key Provisions

  • The CFTC must issue rules, after notice and comment, covering any proprietary information it obtains that isn’t already protected by existing law.
  • The rules must address when the CFTC can request proprietary data, how to safeguard it based on its sensitivity, who may access it within the agency, and how to prevent illegal use or disclosure.
  • When sharing proprietary information with other government entities, the CFTC must obtain assurances that those entities will maintain comparable safeguards and comply with confidentiality limits.
