The Chief Chris Eddy’s Law directs the Secretary of Transportation to create or update rules for moving hazardous materials so that every refrigerated shipping container must display a placard warning of possible pressurization. The rule applies to all such containers, no matter what they are carrying, and covers shipments within the U.S., between states, and internationally. The bill also orders a study on whether refrigerants should be treated as their own hazard class.

Key Provisions

  • The Secretary of Transportation must issue or revise regulations requiring placards on all refrigerated containers to alert emergency responders to pressurization risks.
  • The placarding requirement applies regardless of the type of cargo inside the refrigerated container.
  • The bill defines a refrigerated container as any container capable of refrigeration used in intrastate, interstate, or foreign commerce.
  • The Secretary must conduct a study to evaluate if refrigerants should be a separate hazard category and examine the regulatory impacts of such a classification.

2.

Regulations for refrigerated shipping containers

(a)

In general

The Secretary of Transportation shall issue or revise, as appropriate, regulations relating to the transportation of hazardous materials to require the placarding of all refrigerated containers to communicate to emergency responders the potential of pressurization from such containers.

(b)

Placarding required regardless of cargo

The regulations issued or revised under this section shall require the placarding described in subsection (a) on all refrigerated containers regardless of the cargo such container is transporting.

(c)

Refrigerated container defined

In this section, the term refrigerated container means a container that is capable of refrigeration and used for transportation in intrastate, interstate, and foreign commerce.

3.

Study

The Secretary shall conduct a study to assess whether refrigerants should be formally recognized as a distinct hazard category and include in such study an assessment of—

how the creation of a distinct hazard category for refrigerants would interact with other hazardous material classifications; and

(2)

the broader regulatory impacts of creating such a category.
