The People Over Poison Act would change the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) so that state tort lawsuits about pesticide or device labeling and packaging can proceed. It makes clear that FIFRA does not block or limit those state law claims. The change mainly affects pesticide manufacturers and anyone filing a state tort claim over labeling or packaging issues.

Key Provisions

  • Amends FIFRA Section 24(b) to add language stating that the law shall not be interpreted to prohibit or limit any state tort claim related to the labeling or packaging of pesticides or devices.
