The No Deliveries Act amends the criminal code to make it a federal crime for a non‑citizen or non‑permanent‑resident to enter the United States with the intent of giving birth and to lie about that purpose. It creates a new offense, sets prison terms, and allows immediate removal of anyone convicted. The law targets people who travel to the U.S. for "birth tourism" and affects both the travelers and any children born as a result.

Key Provisions

  • Creates a new offense for anyone who knowingly enters the U.S. to give birth while misrepresenting that purpose.
  • Sets a mandatory minimum prison sentence of at least 10 years (if a child is actually born in the U.S.) and a maximum of 25 years.
  • Allows a U.S. district court to issue a removal (deportation) order at the time of sentencing for any alien convicted under this provision.
