Armed Prohibited Persons Act of 2018

To direct the Attorney General to make grants to States to develop systems to retrieve firearms from armed prohibited persons.

Introduced April 25, 2018

AI-Generated Summary

Updated April 15, 2026 at 9:37 PM UTC

The Armed Prohibited Persons Act of 2018 would have the Attorney General provide grant funding to states so they can create and run programs that take firearms away from people who are legally prohibited from possessing them. The law targets anyone who bought a gun legally but later became disqualified under federal or state law, such as due to a felony conviction. States receiving the grants must ensure the program gives the prohibited person a chance to surrender the weapon voluntarily and must share relevant data with the national background‑check system.

Key Provisions

  • The Attorney General may award grants to states for developing and operating systems that retrieve firearms from armed prohibited persons.
  • States must apply with information the Attorney General deems necessary, including assurances that the system allows the prohibited person a reasonable chance to lawfully dispose of the firearm before it is taken.
  • Grant recipients must agree to provide pertinent data to the national instant criminal background check system (NICS).
  • States must have a plan for ongoing operation and maintenance of the retrieval system.
  • The bill defines an "armed prohibited person" as someone who legally bought a firearm but later became unlawful to possess it under federal or state law.
