Medicare CHOICE Act of 2018

Introduced May 7, 2018

AI-Generated Summary

Updated April 15, 2026 at 9:38 PM UTC

The Medicare CHOICE Act of 2018 changes the Social Security Act so that Medicare Part D prescription drug plans must give enrollees information about the risks of long‑term opioid use and about coverage for non‑opioid pain treatments such as non‑pharmacologic therapies, devices, and medications. The requirement starts with the 2021 plan year and applies to all Medicare beneficiaries who have a Part D plan. Plans can choose to send this information to all members or only to a targeted group, such as people who have received an opioid prescription in the past two years.

Key Provisions

  • Amends Section 1860D‑4(a)(1) to add a new clause requiring plans to disclose information on the adverse effects of prolonged opioid use and on coverage of non‑opioid pain treatments.
  • The disclosure requirement takes effect for plan year 2021 and each subsequent year.
  • Allows plan sponsors to provide the required information to a subset of enrollees (e.g., those prescribed opioids in the last two years) instead of to every enrollee, using mail or electronic communications.
