The Open Book on Equal Access to Justice Act would make information about fee and expense awards to prevailing parties in government-related lawsuits and administrative disputes publicly available online. It requires the Administrative Conference of the United States to maintain searchable databases that list details such as case names, agencies involved, award amounts, and the reasons for the awards. Federal agencies must supply the requested data within 60 days, and the databases must be launched within a year of the law’s enactment.

Key Provisions

  • The Administrative Conference must create and maintain an online searchable database for each fee or expense award in agency adversary proceedings, including case name, agency, claim description, award recipient, amount, and justification.
  • A similar database must be created for fee awards in court cases where the United States is a party, containing the same types of information.
  • Databases cannot disclose information that is prohibited by law or court order.
  • Heads of each federal agency (including the Attorney General) must provide requested information to the Administrative Conference within 60 days of the request.
  • The reporting requirements apply to awards made on or after the law’s enactment, and the databases must be operational within one year.
