SAME Act of 2019

Introduced February 27, 2019

AI-Generated Summary

Updated April 14, 2026 at 2:17 AM UTC

The SAME Act of 2019 changes the Medicaid matching formula so that any state that decides to expand Medicaid receives the same higher level of federal funding as the states that expanded earlier. The law removes the requirement that the extra match only apply to expansions that occurred in specific years, and it makes the higher match apply retroactively to past expansions.

Key Provisions

  • Amends the Social Security Act to replace year‑specific references (2014‑2020) with language that ties the higher federal match to the first, second, … seventh and subsequent 12‑month periods a state provides Medicaid to newly eligible individuals.
  • Ensures the increased Federal Medical Assistance Percentage (FMAP) applies to any state that expands Medicaid, no matter when the expansion happens.
  • Makes the changes retroactive, treating them as if they were part of the original Medicaid expansion law, so states can receive the higher match for expenses incurred before the bill’s enactment.
