The Guidance Clarity Act of 2021 requires every federal agency to add a clear disclaimer to certain guidance documents, stating that the guidance does not have the force of law and does not bind the public or the agency. The Office of Management and Budget must issue implementing guidance within 90 days of the law’s enactment. The rule applies to all agencies that issue guidance under the specified statutory authority and informs the public about the non‑binding nature of such guidance.

Key Provisions

  • Agencies must include a “guidance clarity statement” prominently on the first page of any guidance issued under 5 U.S.C. §553(b)(3)(A) after a 30‑day period following OMB’s guidance.
  • The statement must read: “The contents of this document do not have the force and effect of law and do not, of themselves, bind the public or the agency. This document is intended only to provide clarity to the public regarding existing requirements under the law or agency policies.”
  • The Director of the Office of Management and Budget must issue guidance on how to implement this Act no later than 90 days after enactment.
  • The bill’s budgetary impact is to be assessed using the PAYGO budgetary effects statement submitted by the House Budget Committee chair.
