Updated August 15, 2026 at 12:40 AM UTC

The Ballots by Election Day Act amends the Help America Vote Act to require that absentee and mail‑in ballots for federal offices be received by the time polls close on Election Day. The rule applies to all federal elections beginning in 2027, with a specific carve‑out for uniformed service members and overseas voters.

Key Provisions

  • Absentee or mail‑in ballots must be received by the appropriate election official no later than poll closing time on Election Day to be counted.
  • States may not count any absentee or mail‑in ballot that arrives after polls close on Election Day.
  • The deadline does not apply to ballots cast by uniformed service members or overseas voters, and it does not override any state laws that may set earlier deadlines for those voters.
  • The new deadline rule takes effect for federal elections held in 2027 and thereafter.
  • The bill updates the numbering of HAVA sections (re‑designating sections 305‑306 as 306‑307) and adds the new Section 305 to the Act’s table of contents.
