Mr. Chairman, I'm very glad to be able to offer this amendment with the gentlelady from California. It really is a commonsense amendment, and I do want to address the gentleman from Texas's concern that in the Truth in Lending Act it does protect banks from being victim to fraudulent accounts being opened. It doesn't cover that, but we will certainly work with the gentleman from Texas on language that would make him feel better about what we're talking about now.

Now, I've heard from a number of my constituents regarding credit card companies closing accounts in good standing for no reason other than inactivity. I'm sure many of us have constituents in the same position.

Despite the fact that you can use your credit card on just about anything anywhere, many people do that, but many people prefer to use cash. The part of Pennsylvania where I live is not a young area and it's not an urban area. We have traditional folks who like to use cash and don't like to put a lot of credit on their cards. They use the card for emergencies. They don't use it for sort of day-to-day expenses.

So not only were constituents and neighbors of mine surprised to be losing their credit card privileges, but they were concerned over potential harm to their otherwise great credit ratings due to card companies' desire to wipe inactive accounts from their books.

This amendment would protect people who supposedly underutilize their credit cards from forced closure of their accounts and negatively impacting their credit scores. It requires credit card companies to notify cardholders

at least 30 days in advance of an account closure. It also requires the card companies to tell cardholders that their account closure could adversely affect their credit rating. And it requires card companies to give cardholders guidance on how to appeal the issuer's decision to close the account. It's just a commonsense protection for cardholders. That's all it really is.

And as I addressed earlier, the gentleman from Texas has some concerns. We respect them, and as I mentioned, we're willing to work with him on that.

But in the end, I encourage all my colleagues to support this amendment.

I rise in support of H.R. 1617, the Department of Homeland Security Component Privacy Officer Act of 2009. This legislation will give the Department of Homeland Security the resources it needs to accurately assess how its programs will impact the privacy of Americans.

The Department's Chief Privacy Officer was the first ever statutorily created Federal privacy officer. The goal when establishing this office was for it to serve as the gold standard for other Federal agencies as they sought to fulfill their missions, while ensuring that privacy was protected.

Building on the original intent of the privacy officer, this bill would make the Department the first Federal agency with statutorily created privacy officers in its component agencies. This will put the Department at the forefront of individual privacy protection

and will expedite privacy impact assessments awaiting completion and approval at the Department of Homeland Security.

The bill arose from a Government Accountability Office study, internal discussions with the Department's Office of Privacy, and publications released by the DHS Chief Privacy Officer.

The act requires the Component Privacy Officers to, among other things: Serve as the main point of contact between their component head and the DHS Chief Privacy Officer; draft and review Privacy Impact Assessments and Federal Register notices published by their component; monitor the component's compliance with all applicable Federal privacy laws and regulations; and conduct supervision of programs, regulations, policies, procedures, or guidelines to ensure the component's protection of privacy.

The presence of a full-time Component Privacy Officer would ensure that privacy considerations are integrated into the decision-making process at each of the DHS's components.

This body approved this commonsense measure during the previous Congress, and I urge my colleagues to continue to support this much- needed legislation so that DHS can effectively protect everyone's right to privacy.

Mr. Speaker, public trust in the Department's ability to protect personal privacy rights is abysmally low. The last administration's habit of bringing in the privacy office at the 11th hour is not the proper way to blend in the privacy protections and appropriate safeguards before policies and programs are under way.

Although we trust the new administration to do better, we must also acknowledge that privacy protections have to begin at the component level.

This bill will provide each Department of Homeland Security component that handles personally identifiable information with its own privacy officer that will report up to both its component head and to DHS headquarters. Further, the bill will balance the need for greater accountability of privacy rights associated with personally identifiable information while enhancing the safety of our Nation. I therefore urge my colleagues to support this measure.

Mr. Speaker, I rise in strong support of H.R. 1148, a bill that will enhance the Department of Homeland Security's ability to execute its border security mission in the maritime environment.

The U.S. coastline extends over 95,000 miles, and every day illegal immigrants and potential terrorists attempt to bypass the Department of Homeland Security watchdogs--the Coast Guard and Customs and Border Protection--in their efforts to sneak into the United States. Many of these individuals have already been convicted of felonies in the United States, and many more are wanted by U.S. law enforcement on outstanding warrants for felonies and other dangerous crimes.

As the lead Federal agency charged with border security, it is DHS's mission to keep dangerous people out of our country. H.R. 1148 authorizes DHS to use technology that has been successfully piloted by the Coast Guard and the US-VISIT program since November of 2006 to identify dangerous people before they cross our borders and to better coordinate prosecution with Federal law enforcement agencies.

For example, as of March 3, 2009, the department has collected biometric information from 2,455 individuals interdicted in the Mona Pass, a 90-mile stretch of water in the Caribbean between Puerto Rico and the Dominican Republic.

DHS uses satellite technology to immediately compare the individual's fingerprints against the US-VISIT databases, which includes information about wanted criminals, immigration violators, and those who have previously encountered government authorities. Of these nearly 2,500 individuals who have been checked, almost 600 people have been found to have outstanding wants and warrants in the United States.

To date, Federal prosecutors have successfully prosecuted 271, or 45 percent, of the matched individuals. As a

result, migrant flow in the Mona Pass has been reduced by 75 percent since November 17, 2006.

I would like to note that my colleague on the Management, Investigations and Oversight Subcommittee, Representative Bilirakis, had already an identical bill in the 110th Congress. And I was pleased to support his homeland security measure that passed the House by a vote of 394-3, with one Member voting present.

I urge my fellow Members to vote for this bill, one which gives the Secretary of Homeland Security the tools she needs to secure our Nation's maritime border.

I urge passage of H.R. 1148, a bill to harness technology used for the past 3 years by the Coast Guard and the US-VISIT program to enhance border security in the maritime environment. H.R. 1148 seeks to build upon the success of the DHS pilot by requiring the Secretary of Homeland Security to analyze the cost of deploying the biometric program in other waters.

If enacted, H.R. 1148 would enhance the ability of DHS to conduct mobile biometric identification of suspected individuals, including terrorists interdicted at sea.

For these reasons, I urge my colleagues to join me in supporting H.R. 1148.

Mr. Speaker, I urge passage of H.R. 730, the Nuclear Forensics and Attribution Act. I would like to congratulate Congressman Schiff, Emerging Threats Subcommittee Chairwoman Yvette Clarke, and her predecessor, Jim Langevin, for the thoughtful approach they have taken on this critical homeland security concern.

I would like to thank our members on the other side as well. This is a bipartisan issue that certainly does not cross party lines. It affects everyone. Given the catastrophic consequences of a nuclear weapon, it is imperative that the U.S. have a state-of-the-art nuclear forensics capability.

While a nuclear bomb is commonly referred to as a weapon of mass destruction, a radiological dirty bomb is better described as a weapon of mass disruption. A dirty bomb, if detonated, will likely kill few people. The main damage it would cause would be economic because it could render important commercial areas unusable due to radioactive contamination. In either case, we must build and sustain a nuclear forensics capability and workforce to address the nuclear and radiological threats that we face today. That is why I urge a ``yes'' vote on H.R. 730.

Mr. Speaker, I rise today to honor the 2008 Pennsylvania State championship boys cross-country team, the Elk Lake Warriors. I am blessed to have five terrific kids, all of whom attend Elk Lake, and my oldest three boys are all cross-country runners.

The cross-country team's victory is remarkable for many reasons, it's only the third State championship that Elk Lake has ever won. But what I found truly remarkable was their inspirational path to victory. Not one runner on the team won an individual medal at the State meet, but working together, they won the State title, an incredible lesson for us all. They each gave it their all and demonstrated an incredible dedication to each other and their team; they were victorious.

As we know, our Nation is facing incredible challenges right now. It is all too easy to forget the simple value of pulling together and putting aside our differences in difficult times. I am confident that if we all heed the lessons offered by a small rural school in Pennsylvania, we will succeed. And once again, my congratulations to the 2008 State champions, the Elk Lake Warriors.

Mr. Speaker, I rise today to support House Resolution 195, a measure to honor the employees of the Department of Homeland Security and to mark the sixth anniversary of the Department's creation.

The Department of Homeland Security was tasked with the Herculean responsibility of coordinating with State, local, and tribal entities to prevent future terrorist attacks, secure our borders, and to prepare for and respond to events of national significance. Comprised of 22 different Federal agencies

and employing over 223,000 of our finest Federal employees, DHS quickly became one of the largest Federal departments.

Twenty-four hours a day, 7 days a week, 365 days a year, employees of the Department of Homeland Security are working to prevent and prepare for any threat to our country. At this very moment they are patrolling our skies, securing our borders, sailing our coastal waters, and screening people and cargo entering our country. They are also collaborating, cooperating, and coordinating with State, local, and tribal governments and first responders in all 50 States and our territories to ensure we can respond to any future large-scale events either man-made or natural. These dedicated Homeland Security employees are working tirelessly to improve the safety for all Americans and are doing a commendable job.

Department of Homeland Security employees stand willing, ready, and able to respond should catastrophe strike. They work long hours to deter, detect, and prevent acts of terrorism against the homeland. They can be sure that Congress will continue to conduct vigorous oversight of management at DHS, but I cannot stress how much we truly appreciate the work of the dedicated DHS employees working to protect the safety of all Americans.

My thanks to Congressman Bilirakis for introducing the resolution and to the Speaker for the time on the floor today. I encourage my colleagues to support House Resolution 195 as we honor the employees of the Department of Homeland Security.

As you have heard, Mr. Bilirakis and I discussed the Department of Homeland Security and the importance of the employees and the incredible talents that they represent in protecting us 24/7/365. It's actually the most important job we have in this country right now. They are keeping the borders safe. They are making sure we are not attacked, and they have prevented the attacks since 9/11. That in combination with our support will make them the finest domestic force that we have.

I encourage every Member of this body to vote for H. Res. 195.

Madam Speaker, I rise today in very strong support of H.R. 553, the Reducing the Over-Classification Act of 2009. It's an essential part of our national security, and this act is identical to one that passed the House last year, H.R. 4806.

I was proud to work on that legislation with Ms. Harman and my other Intelligence Subcommittee colleagues last year, and I am pleased that we are moving it anew this Congress. Our goal is a simple one, to make DHS the gold standard when it comes to classification practice.

As someone with many years of intelligence experience as a member of the U.S. military, I know that intel is useless if it doesn't get to the people who need it. And I have witnessed personally the missed opportunities that can arise from over-classification.

That's why H.R. 553 is designed to ensure that as much homeland security information as possible is shared with the Department's State, local, tribal and private sector partners, the men and women on the front lines of the Nation's homeland security efforts.

As the 9/11 Commission and others have noted, it is those officers who, during their day-to-day police work, are most likely to uncover a terrorist plot in the making, and those who are best positioned to disrupt or even prevent it. They are not only our first responders, they are also our first preventers.

Unfortunately, what we have heard time and again from those officers is not encouraging. They are not getting important information that can keep people safe because too much of it is stamped ``Top Secret.''

H.R. 553 will promote accountability and best practices at DHS by requiring employees and contractors to use the classification regime the way it was intended: To protect sensitive sources and methods, not to hide embarrassing facts or protect political turf.

Among other things, H.R. 553 will promote accountability by requiring that all classified intelligence products created at the Department be simultaneously created with a standard unclassified format as well if such a product would help police and sheriffs keep us safe. This will help change the intelligence culture that is still far too comfortable with classifying rather than sharing.

H.R. 553, likewise, will promote accountability by requiring the Secretary to create an auditing mechanism for the DHS Inspector General that randomly samples classified intelligence products, identifies problems that exist in those samples, and recommends improvements to fix them.

To further engage Department staff in their efforts to get classification right, H.R. 553 requires the Secretary to establish a process through which employees may challenge original DHS classification decisions and be rewarded for bringing those abuses to light.

The legislation further requires the Secretary to establish penalties for staff who repeatedly fail to comply

with applicable classification policies, despite notice of their noncompliance and an opportunity to undergo retraining.

Perhaps. H.R. 553 is a bipartisan fix to a decades-old problem that will only get worse if we don't act now.

Mr. Speaker, I rise in support of S. 2403, as amended. This bill honors the distinguished careers of two giants in the civil rights field.

From 1948 until 1960, Judge Robinson served at the NAACP's Legal Defense and Education Fund. During that time he was instrumental in representing the Virginia plaintiffs in the landmark lawsuit Brown vs. Board of Education, which declared separate but unequal schools as unconstitutional.

In 1961, President John F. Kennedy appointed Judge Robinson to the U.S. Commission on Civil Rights, a six-member bipartisan commission charged with studying civil rights violations in the United States. Judge Robinson was confirmed by the Senate by a vote of 73-17.

In 1964, President Lyndon B. Johnson appointed Judge Robinson to the District Court, and 2 years later he became the first African American to serve on the U.S. Court of Appeals for the D.C. Circuit. Judge Robinson served as Chief Judge of the U.S. Court of Appeals from 1981 to 1986, and served on the Court until his retirement in 1992.

Judge Robert Merhige, Jr. was born in Brooklyn, New York on February 5, 1919. Judge Merhige attended High Point College in North Carolina and received his law degree from the University of Richmond's T.C. Williams School of Law in 1942. Upon graduation he enlisted in the United States Army Air Corps, where he served as a crewman aboard a B- 17 bomber based in Italy.

Judge Merhige was U.S. district judge for the Eastern District of Virginia in 1967. He served there for over 30 years. He was a frequent lecturer at the University of Virginia and served on the faculty of the University of Richmond. While on the bench, Judge Merhige ordered the University of Virginia to admit women, and 2 years later he led the order to desegregate dozens of schools in Virginia.

Two weeks into his service on the court, Judge Merhige drew the first of many high-profile cases that became the landmark of his career. He ordered the release of black activist H. Rap Brown, who was imprisoned in Virginia after making an impassioned and militant speech in Maryland.

Mr. Speaker, this bill has broad bipartisan support, and I urge my colleagues to join me in supporting this bill.

Mr. Speaker, I rise in support of S. 2837, a bill which designates the courthouse located at 225 Cadman Plaza East, Brooklyn, New York, as the Theodore Roosevelt United States Courthouse.

As we all know, President Roosevelt was the 26th President of the United States. He led an extraordinary life. He steered the United States into world politics and was a polished and accomplished public servant and indeed was a Nobel Peace Prize winner.

Theodore Roosevelt was born in New York City on October 27, 1858, and died in Oyster Bay, New York, in 1919. He served as the 26th President of the United States. During his youth, he struggled with ill health and later dedicated his life to strenuous outdoor activities and Spartan living. He served during the Spanish American War, leading the Rough Rider Regiment, which became famous during the battle of San Juan Hill.

He was elected Governor of New York in 1898. Upon the assassination of President McKinley in 1901, he became President, and served until 1909. He believed the government should serve as an equal and fair arbiter between great economic forces such as labor and management.

Roosevelt's life was rich with varied experiences. He served as Police Commissioner of New York City, Governor of New York, and was an avid outdoorsman and naturalist, an ardent conservationist, and the author of 26 books. As I mentioned before, he was awarded the Nobel Peace Prize in 1905. He died peacefully in his sleep in 1919.

I support this bill, and I urge my colleagues to join me in supporting it.

Mr. Speaker, in the coming days, the House will once again consider the new GI Bill which restores the promise of a 4-year college scholarship for Iraq and Afghan veterans, similar to the educational benefits available after World War II. The original GI Bill of 1944 allowed millions of families to achieve the American Dream and set the economy on the right course after a draining war.

After World War II, for every dollar spent on the GI Bill, $7 was returned to the economy. The new GI Bill will spark yet another American economic recovery, one that is needed during this time of economic uncertainty with skyrocketing gas prices and food prices and devastating job losses.

But even more importantly, it will fulfill our promise to our military personnel that if they serve their country in war, they will receive a quality education at home. The current benefit simply does not live up to that promise. Mr. Speaker, while President Bush and his Republican allies remain strong advocates for continuing the war in Iraq, it is important that they join us in keeping this important promise to our Nation's troops.

Mr. Speaker, House Concurrent Resolution 308 authorizes the use of the Capitol Grounds for the 27th National Peace Officers' Memorial Service. Statistics from the National Law Enforcement Officers Memorial Fund indicate that, in 2007, 181 officers died in the line of duty, and they will be honored at this year's memorial service.

On average, in the United States a peace officer is killed every 53 hours. Sadly, these numbers make 2007 one of the deadliest years for peace officers. Five officers were women. Forty States plus the District of Columbia experienced officer fatalities in 2007; 13 States had five or more fatalities.

In 1962, President John F. Kennedy signed a proclamation which designated May 15 as Peace Officers Memorial Day and the week in which that date falls as Police Week.

The first official Memorial Service took place on May 15, 1982, at which 91 law enforcement officers were honored. Over the past 27 years, the Memorial Service has honored over 3,000 law enforcement officers from around our Nation. Today, the National Peace Officers' Memorial Service on Capitol Hill has become one in a series of well-attended events during Police Week.

Activities on the Capitol Grounds conducted under H. Con. Res. 308 will be coordinated with the Office of the Architect of the Capitol, will be free

and open to the public. I support this resolution and urge its passage.

Tonight I urge my colleagues to support the amendment that I am offering to H.R. 5819, the SBIR/STTR reauthorization bill.

The amendment is good for America's small businesses and will increase our technological competitiveness in the global marketplace. Specifically, the amendment would allow the administrator of the SBA to view favorably FAST grant applicants that utilize small business development centers that are accredited for their technology commercialization in determining the award of a FAST grant.

My amendment acts as a catalyst that will encourage and enable 41 State SBDC programs to develop the capacity to deliver technology commercialization services. The result will be an increase of new technology and technological products introduced into the marketplace improving America's competitiveness, as it strengthens America's small business community.
