Floor Statements

Madam Speaker, in just a few short weeks, my 8th term as Representative for the Fourth Congressional District of Kansas will come to an end, and I want to thank my constituents for giving me the opportunity to serve them these past 16 years. It has been a profound honor to represent Kansas in our Nation's Capital and to be a Member of this Institution.

Much has changed since I first walked onto the House floor in January 1995 following the historic Republican Revolution of 1994. We have witnessed the impeachment of a U.S. president, four years of balanced budgets, the end and beginning of a new millennium, the 9/11 terrorist attacks, an ongoing global war against terror, and the collapse of established financial and business institutions world-wide.

Other things have changed very little. We are still fighting against run-away federal deficit spending. The false notion that new government programs will solve our greatest problems continues to plague Washington despite attempts at cutting waste.

Thanks to the Tea Party movement, a new wave of fiscally conservative Representatives will take office in January, and I am hopeful we will see renewed progress in putting Washington on a diet.

One of the privileges of serving Kansas has been to achieve real results for our communities. During my Congressional tenure, we were successful in repealing the Wright amendment to help lower air fares, return millions of tax dollars back to Kansas to help build dozens of important infrastructure projects, protect the rights of the unborn through the 1998 Tiahrt amendment, secure over $90 million in funding for the National Institute for Aviation Research at Wichita State University and place a statue of General Dwight D. Eisenhower in the U.S. Capitol Rotunda where it will remain permanently.

Working with Sen. Brownback and Sen. Roberts, we successfully fought back attempts to procure a European refueling tanker and have made the case for purchasing an American tanker made by an American company with American workers. It is my continued hope that the Air Force will make the right decision and select the KC-767 that will employ thousands of skilled engineers and workers in Kansas.

Mr. Speaker, as I reflect on my service in the House, I want to take this opportunity to thank my wife, Vicki, and my children who have supported me and walked with me on this 16-year journey. Serving in Congress is often most difficult on a member's family. We purposefully chose to serve these 16 years together. My wife and children were part of every term. I was blessed to have them with me to roam the marble halls of Congress, meet America's leaders, and get to know the citizens we served. Watching history unfold with my family by my side gave me many memories I will forever cherish.

Throughout my time as a Member of Congress, I have remembered my family is a gift from God and will always be my greatest accomplishment. Their work on numerous projects throughout Kansas has made our state and country a better place to live, and their love and encouragement continue to inspire me. I am so glad to be finishing this chapter of my life with Vicki, Jessica and John by my side, and we would give anything if Luke were here, too.

Many of the difficult tasks here in Congress could not be done without the hard work of staff. I have been blessed with committed staffers who stood with me as I fought for our Kansas values and a limited government.

My staff, past and present, worked tirelessly, not only for me, but for the people of Kansas and for our country.

Robert Noland has been with me since day one. He has been a loyal and faithful friend and has shown tremendous wisdom in managing my district office. I will never forget his years of hard work and dedication to me and to our state.

Jeff Kahrs has been with me since my first term in office, and I am grateful for his friendship, leadership and counsel over the years. His perception and vision have helped me focus on what's important.

Connie Voss has also been with me since my first term in office. Connie and her husband Joe have been a gift from God to Vicki and me throughout the years, and we deeply appreciate their prayer and faithful support.

Amy Claire Brusch has been with me for nearly 11 years and has served with stellar performance providing leadership on numerous legislative initiatives in my Washington office. Her knowledge of how Capital Hill works has helped me navigate complex legislative and political issues.

Linda Arensdorf has been on my official staff for more than 10 years and has been instrumental in helping manage the district office and working to make sure our constituent service projects are carried out with excellence.

Sam Sackett has also served on my staff for more than a decade and has contributed to several legislative initiatives in Washington and has helped me effectively and clearly communicate my message across the state of Kansas.

Melissa James has been responsible for managing my appointments and has done a tremendous job keeping impeccable schedules. Melissa's attention to detail and her dedication to her job have played an important role in making sure I manage my time wisely.

Chuck Knapp has played a critical role advising me on numerous issues related to policies and district matters. I appreciate his friendship and value his advice that has helped me better serve my constituents.

Josh Bell has served on my staff in several important roles, including as part of my legislative team in Washington as well as in my district office managing special projects for constituents. His faithful dedication and hard work have served me well for many years.

Jeremy Wisdom has provided valuable assistance to countless veterans and other constituents needing help with a federal agency. His knowledge of the federal system and thoughtful approach to problem solving has helped resolve numerous constituent problems.

Jim Richardson has a thorough knowledge of military and defense issues that has been an enormous asset to my legislative office. He has provided critical insight and a thoughtful approach to helping me deal with issues related to our national defense.

Laurel Scott has greeted thousands of Kansans visiting my Washington office over the years. Her warm smile, welcoming personality, and prayers for my family have meant so much to Vicki and me.

Wendy Knox has helped me disseminate our legislative message to the public by working with national media in Washington as well as state and local reporters. Her communication skills and commitment to the conservative cause has helped clarify and focus our messages.

Matthew Stroia has served on my staff focusing on several issues related to the aerospace and energy industries. I appreciate the way he applied his skills and knowledge of the legislative process to help ensure Kansans' interests were made a top priority.

Richard Henkle has been a committed legislative staffer who has helped me focus on several issues impacting Kansas. His work on agriculture, bio-security and pro-life issues has made a real difference to our state.

Sarah Osborn has served in my Washington office helping me with the House Economic Competitiveness Caucus agenda as well as ensuring constituent responses were fully addressed. I am grateful for the countless tasks she has done to help make our legislative office run successfully.

Jill Craven has dedicated a meticulous attention to detail and put her talents to work helping constituents receive prompt and informative responses to concerns with government agencies. Her never-quit attitude has benefitted constituents across the state of Kansas.

Mark Dugan has performed admirably in ensuring my office remained responsive to constituents, and he was instrumental in several of my efforts to reach constituents with information about what was happening in Washington.

Joel Katz has served in my Washington office helping the legislative staff meet its deadlines and achieve our goals. His hard-work, commitment to getting the job done and dependability made a huge difference to me and to the constituents he served.

Kenya Cox has an incredible dedication to many causes that have benefitted our district and the entire state. I appreciate her dogged and persistent work ethic in response to constituent requests. Her commitment to resolving problems and her tenacity in getting the job done well is admirable.

Andy Purath has served me in Washington for the last year as a congressional military fellow. I appreciate his hard work in the legislative office and his willingness to serve our country.

Mariam Bell has helped us complete the archive process on deadline and has been a blessing to Vicki and me for many years. I am thankful for her thoughtful approach to handling an enormous task.

My family and I deeply appreciate all our supporters and friends who have lifted us up in prayer and those who have given so much to make the impossible happen. For the past 16 years as I traveled to work and saw the Capital dome in the morning, I would pray, ``Lord, help me do the right thing.''

God has answered that prayer by surrounding me with a family and staff who, along with thousands of friends and supporters, have helped me faithfully carry out my responsibilities.

In the coming months and years, many tough decisions will be made in terms of what we do as a country. The success of our nation depends on engaged citizens who believe, as our Founding Fathers did, that the government should be by the people and for the people. We must all remain in the fight to help make Kansas and our country stronger, more prosperous and an even better place to raise a family.

Vicki and I look forward to continuing that journey with all those who have so faithfully walked with us.

While there are numerous other people that could be mentioned, I again want to say what an honor it has been to serve in the U.S. House of Representatives on behalf of the people of Kansas who sent me here these past 16 years.

Madam Chair, we have a moral obligation to fully fund our veteran programs. The liberties we enjoy today were earned through the bravery and sacrifice of patriotic Americans. Congress must ensure that these honorable men and women have access to benefits and top-notch healthcare. We can never turn our back on our veterans.

As such, I am pleased to support H.R. 5822, the Fiscal Year (FY) 2011 Military Construction/Department of Veterans Affairs Appropriations bill. This legislation continues the goal set by the Republican majority to prioritize veteran programs. H.R. 5822 provides $56.8 billion in discretionary funding for the VA and $64.0 billion for mandatory VA programs. The legislation also makes available $37.1 billion to improve access to medical services for all veterans, $2.4 billion above last year's level.

Among some of its most significant provisions, H.R. 5822 provides $50.6 billion in advance appropriations for VA medical accounts to ensure stable and uninterrupted services. It also provides new family caregiver benefits for disabled veterans as well as additional VA workers to address the continuing claims backlogs and to process new educational benefits. To address the needs of rural veterans, the legislation provides $250 million for innovative practices to improve access to care for veterans in rural areas. This is particularly important to many Kansas veterans.

In addition to supporting this legislation, I applaud the work of all the Veteran Service Organizations (VSOs) who contributed to the bill. From the Veterans of Foreign Wars to the American Legion, VSOs provide the appropriations committee invaluable information on the needs of the veteran community. They are tremendous advocates for all veterans.

H.R. 5822 is a good bill worthy of strong bi-partisan support. I encourage my colleagues to join with me in voting for this legislation.

Madam Speaker, I rise to honor a man who has fought for the honor of millions of Americans.

Jim Martin has a distinguished track record of public service that began as an United States Marine from 1953-1958. He then went on to have a successful career in politics and journalism. In 1992, Jim founded ``the 60 Plus Association'' an organization that has become an influential voice for seniors all across the nation. Jim has been a fierce advocate for all issues facing seniors, especially the solvency of Social Security, energy independence and the ``Death Tax.''

Jim has been the voice of our nation's seniors in Washington, reminding Congress of the importance of taking action to ensure Social Security is able to meet the needs of seniors who depend on the program, while at the same time ensuring our children and grandchildren have the same opportunity for a retirement safety net. Grandparents are just as concerned with their grandchildren's future as with their own welfare.

Over the past year, Americans have been feeling additional strains on their budgets with the increased energy prices--this is especially true for seniors. The increase in energy prices has a burdening effect upon those with fixed incomes who struggle to pay bills and are too often forced to make difficult choices between food, medicine and transportation costs. Jim knows and understands their concerns and has been a leading proponent for energy security.

Jim has also led the charge against one of the most egregious taxes in our tax system, the estate tax. Jim is credited for reframing the debate over the estate tax by renaming the tax to the more appropriate term, the ``Death Tax.'' As a result of this tax, a business that has been in a family for generations can be lost overnight because of the enormous burden of the death tax. When a business leaves its family roots, there is a loss of pride in the fundamental traditions that helped make the business successful. This is not the legacy parents want to leave their children and grandchildren.

On behalf of all Americans, I want to thank Jim Martin for his service to our country. On behalf of our nation's seniors, I want to thank Jim and the 60 Plus Association for their efforts to ensure the solvency of our Social Security system, protecting seniors against rising energy costs, and permanently eliminating the ``Death Tax.''

Madam Speaker, on July 13th, I missed three rollcall votes numbered 434, 435, and 436 because I was unavoidably detained in Kansas.

Rollcall No. 434 was a vote on H.R. 4514, the Colonel Charles Young Home Study Act. Had I been present I would have voted ``no.''

Rollcall No. 435 was a vote on H.R. 4438, the San Antonio Missions National Historical Park Leasing and Boundary Expansion Act of 2010. Had I been present I would have voted ``no.''

Rollcall No. 436 was a vote on H.R. 4773, the Fort Pulaski National Monument Lease Authorization Act. Had I been present I would have voted ``aye.''

Madam Speaker, Iran continues down a dangerous path that must he confronted with resolve and action. Unfortunately, instead of supporting the national interests of the United States, the Obama administration has attempted to aid hostile regimes over allies, supported dictators over democracy, and been more interested in talking to our adversaries than supporting our long-standing friends in the Middle East. To redirect U.S. foreign policy in the region, I am pleased to be a co-sponsor of H.R. 2194, the Comprehensive Iran Sanctions, Accountability, and Divestment Act, which we are considering today.

The threat posed by Iran is clear. First, we know that Iran is developing nuclear weapons. In 2009, Dennis Blair, Director of National Intelligence testified before Congress that ``Iran has the scientific, technical, and industrial capacity to eventually produce nuclear weapons.'' He went on to say that Iran could soon have enough highly enriched uranium for a nuclear weapon.

Second, we know that Iran has advanced short and medium-range missiles, and is rapidly developing capable longer-range missiles. Iran has already deployed the Shahab-3 missile, which has a range of over one-thousand miles. This missile can strike Israel and allies in Europe as well as American troops deployed in the Middle East, Asia and Europe. In February, Iran launched its first satellite into space. There are just relatively minor technological steps between a space launch and an inter-continental ballistic missile launch. In fact, a recent Air Force report said Iran's ``ambitious ballistic missile and space launch development programs'' could allow them to have an inter- continental ballistic missile capable of hitting the United States by 2015.

Third, we know Iran is the world's most active state sponsor of terrorism. According to our own State Department, ``Iran's involvement in the planning and financial support of terrorist attacks throughout the Middle East, Europe, and Central Asia had a direct impact on international efforts to promote peace, threatened economic stability in the Gulf, and undermined the growth of democracy.'' Iran provides aid in the form of weapons, training, and funding to Hamas and other Palestinian terrorist groups, Lebanese Hezbollah, Iraq-based militants, and Taliban fighters in Afghanistan--and those are the ones we know about.

Finally, we know that Iranian leaders continue to call for the destruction of Israel. Israel is our most important ally in the Middle East. The United States has a strategic and moral responsibility to stand with them against all threats and aggression.

To counter this clear Iranian threat, I am pleased the House is today considering the conference report for H.R. 2194. This legislation will dramatically limit Iran's ability to import and produce refined petroleum products by requiring the president to impose sanctions on companies helping Iran in these areas. The bill also adds three new sanctions to limit Iranian access to the U.S. banking system and foreign exchanges, and toughens the sanctions regime by requiring the president to investigate any reports of certain sanctionable activity for which there is credible evidence and make a determination to Congress whether such activity has indeed occurred.

While the Obama administration has failed to alter Iranian action through appeasement, H.R. 2194 will take serious actions. Although a large oil producer, Iran is dependent on imported refined petroleum products. With these new sanctions in place, the Iranian economy will be dramatically hindered and hopefully Iran will be forced to change course especially in regards to nuclear weapons program.

While I join with my colleagues in strong support of this legislation, I am disappointed with two aspects of this conference report. First of all, the timing. This legislation was introduced 14 months ago and passed on the floor of the House six months ago. All of these delays were at the behest of the Obama administration due to their continued opposition to the bill. The administration finally allowed the legislation to move forward only after securing an important concession providing the President extensive waivers, which is my second concern.

Originally containing limited waiver authority, Democrats added much more extensive presidential waivers. This is a farce and undermines the legislation. The administration has shown time and time again its interest in appeasement and opposition to a strong sanctions regime. I fear this important legislation will just be waived like so many other sanction laws aimed at Iran.

While I support this conference report, I call on the administration to not utilize any waiver authority and allow every sanction in this bill to take effect. This legislation is the clear will of Congress and the American people, and should be carried out to its fullest extent by the administration.

Madam Speaker, H.R. 2194 is not perfect, but it is a good step forward in protecting U.S.-vital interests. Therefore, I encourage my colleagues to support final passage.

Mr. Speaker, on June 30, 2009, the Obama Administration released details of its proposal to establish a Consumer Financial Protection Agency. It proposed an independent agency housed within the executive branch to regulate the provision of financial products and services to consumers. Now, one year later, this proposal has morphed into

a 2,300 page bill that further extends the federal government's grasp on more aspects of our economy.

I voted against this bill on December 11, 2009 but despite my opposition, H.R. 4173 passed the House of Representatives on a straight party line vote--with not one Republican voting in favor of the legislation. On June 30, H.R. 4173 came back from the House-Senate Conference Committee, which ironed out the differences between the two bills. Again, I opposed this legislation. Despite my opposition, the bill ultimately passed by a margin of 237-192. The legislation now awaits further action in the Senate.

This is the wrong bill at the wrong time that punishes the wrong people. In the midst of continuing economic turmoil, this bill increases the size of government, expands its reach in the market place, jeopardizes the safety and soundness of many of America's financial companies and non-financial companies, and significantly increases the cost of credit for all consumers at a time when consumers can least afford it. This legislation overreaches and will affect companies and community banks that had nothing to do with the financial crisis.

These reforms will continue to perpetuate the bailout mentality that has plagued our nation and eliminate access to credit for many small businesses and families at a time when they need it most.

The conference report will abolish the Office of Thrift Supervision (OTS). The transfer of its powers and duties will have to be done within one year after the conference report's enactment. The conference report will transfer to the FDIC the authority to regulate all state savings associations. The OCC, which would be a bureau within the Treasury Department, would regulate all federal savings associations. The conference report also preserves the thrift charter.

The conference report also requires the Federal Reserve to ensure the fees charged to merchants by credit card companies for credit or debit card transactions are reasonable and proportional to the cost of the processing those transactions. The consequences of government artificially imposing its heavy hand into private transaction will further slow our economy. We can't even get a federal budget passed, so what justification does the government have to determine transaction fees.

As one of my colleagues pointed out, economists don't often see eye to eye, but they seem to agree that if one side of the market has its costs artificially lowered, the other side of the market will see increased costs. This means that, in this battle between retailers and banks, debit card holders and account holders will likely foot the bill.

Creating more regulatory burdens and a new government agency full of unelected bureaucrats to pick the winners and losers in the private- sector is not the answer. This will only serve to crush more jobs and paralyze our economic growth even more. Kansans have had it with the only solution the administration continues to offer: more government.

I am in strong opposition to H.R. 4173. I worry about its impact on our economic freedom and will work to repeal these harmful policies.

Mr. Speaker, this legislation is long overdue. For years, there have been inconsistencies in the manner in which manufacturers pay their taxes. Under current law, firearm and ammunition manufacturers pay excise taxes into the fund on a bi-weekly basis. All other manufacturers pay on a quarterly basis. This legislation will change this inconsistency and bring a little commonsense into our crazy tax system.

I am pleased to be a cosponsor of H.R. 510, to amend the Internal Revenue Code to require that the payment of the manufacturers' excise tax on recreational equipment be paid quarterly. The frequency of tax payments for the firearm and ammunition manufacturers is a burden on the industry. In fact, some manufacturers are forced to secure short- term loans to pay their taxes, thus incurring additional expenses and adding to administrative overhead. The end result is that money is diverted away from core business areas to finance tax payments.

Through this legislation, firearm and ammunition manufacturers will now be able to reinvest more funds into researching and developing new products, purchasing new manufacturing machinery, and increasing marketing and outreach to the hunting and sport shooting community. The federal government will get their taxes, on a quarterly basis as it does from every other manufacturer, so no revenue will be lost.

I urge my colleagues to support the Firearms Excise Tax Improvement Act.

Madam Speaker, on rollcall No. 395 I was unavoidably detained. Had I been present, I would have voted ``no.''

Mr. Chair, I stand in vehement opposition to H.R. 5175, the Democracy is Strengthened by Casting Light on Spending in Elections Act. The DISCLOSE Act is a hasty, ill-conceived, un-Constitutional response to the near unanimous decision of the U.S. Supreme Court in Citizens United vs The Federal Election Committee. In that ruling, Justice Kennedy, writing for the majority, stated that:

When Government seeks to use its full power, including the

criminal law, to command where a person may get his or her

information or what distrusted source he or she may not hear,

it uses censorship to control thought. This is unlawful. The

First Amendment confirms the freedom to think for ourselves.

The DISCLOSE Act takes us down a familiar road of the majority acting to remove the First Amendment rights of the minority, including the rights of those who are fighting to defend the sanctity of life. For over a year, the Democrat majority in Congress and the White House have held the voice of the American people in contempt, whether at town halls or on the National Mall. Instead of listening, they would rather find ways to silence us.

The DISCLOSE Act is designed to impact this year's election by immediately placing its provisions into effect without the normal regulatory vetting process that occurs when a bill is signed into law. It is also a discriminatory bill, with requirements that do not apply equally to all citizens, but are based on the type of activity or speech they are involved in. Nowhere in the Constitution does the Federal Government have the right to decide who has the right to speak up. It is specifically designed to exempt most Unions from the reporting requirements. It requires CEOs of corporations to appear in any ads that their companies have funded, in whole or in part, and state the name of the company, twice. These limits on First Amendment rights are not in keeping with the intentions of the Founding Fathers.

This bill is an abhorrent attack on our rights and it will not stand up to the scrutiny of the courts. This hallowed body should not even be considering it. I urge my colleagues to send this bill back to where it deserves to go, the dust bin.

Mr. Chair, the passage today of the so-called DISCLOSE Act, is a travesty. This bill is a hasty, ill-conceived, un- Constitutional response to the near unanimous decision of the U.S. Supreme Court in Citizens United vs The Federal Election Committee. The DISLOSE Act takes us down a familiar road of the Democratic majority attempting to remove the First Amendment rights of the minority, including the rights of those who are fighting to defend the sanctity of life. For over a year, the Democrat majority in Congress and the White House have held the voice of the American people in contempt, whether at town halls or on the National Mall. Instead of listening, they would rather find ways to silence us. This bill is a direct attack on our rights and will not stand up to the scrutiny of the courts. This hallowed body should not have even considered it. I urge the Senate to send this bill back to where it deserves to go, the trash bin.

Mr. Speaker, I rise today to offer my support for H. Res. 1389, and for fathers across the Nation. Nearly 50 years ago, Daniel Patrick Moynihan warned that, ``. . . A community that allows a large number of

young men to grow up in broken families . . . never acquiring any stable relationship to male authority, never acquiring any rational expectations about the future--that community asks for and gets chaos.'' Moynihan's words hold a prophetic ring as we look at society today.

Fathers play a critical role in the development of their children, positively influencing everything from academic performance to mental and physical health. Children who do not live with both parents are more likely to repeat a grade, have lower grades, be diagnosed with a mental illness, experience drug or alcohol abuse problems, and commit violent crimes.

I do not mean to imply that those who grow up without both parents are doomed to failure, nor am I suggesting that children from two- parent homes are guaranteed success. But the presence of fathers in the lives of their children does have benefits that cannot be denied. This Congress, and America as a whole, are right to take time to honor the men who took responsibility for their actions, who invest in the lives of their children, who sacrifice their own wants and desires for the sake of future generations. So I urge my colleagues to join me in supporting H. Res. 1389 as it is considered today.

I would also like to take this opportunity to express my appreciation for the sacrifices made by my own father, Wilbur Tiahrt. His sacrificial leadership, during his service in the Army Air Corps during World War II, and as a father and husband has provided a tremendous example for me and my siblings. I am grateful for the blessing that he has been to me and my family, and each Father's Day, I am reminded of how fortunate I am to still have him with me.

Mr. Speaker, I join my colleagues in strong support for H. Res. 1385 to recognize and honor the courage and sacrifice of the members of the Armed Forces and veterans. Though we appreciate their sacrifice every month, it is important this resolution is passed this month as May is expressly designated National Military Appreciation Month.

We can never say ``thank you'' enough for the sacrifices paid by the Nation's military. The liberties we enjoy today were earned through the bravery and sacrifice of ordinary Americans with extraordinary selflessness. America must never turn her back on her service members and veterans.

We know all too well that freedom is not free. They courageously stepped forward to protect and defend the Constitution and the people of the United States. This resolution is just a small tribute to the great character of all our military service members and veterans.

I urge all my colleagues to join with me in supporting H. Res. 1385 and thanking current and former servicemembers for guaranteeing our freedom.

Madam Speaker, I join my colleagues in strong support of H.R. 5145, Assuring Quality Care for Veterans Act. This legislation authorizes the Secretary of Veterans Affairs (VA) to reimburse VA health professionals for continuing professional education expenses.

Our Nation's veterans deserve high-quality medical care. This means having top-notch facilities and equipment, and highly-trained medical professionals. Many professions require continuing education, and it is absolutely essential in the medical field. With constantly changing techniques, procedures and treatments, continuing education is indispensable for medical providers. This legislation rightfully will ensure that our VA medical professionals have access to continuing training and therefore ensure that our veterans receive the best care possible.

I urge all my colleagues to join with me in support of H.R. 5145 to provide high-quality medical care for our Nation's veterans.
