Floor Statements

Mr. Speaker, I move to suspend the rules and pass the joint resolution (H.J. Res. 75) making further continuing appropriations for the fiscal year 2006, and for other purposes, as amended.

Mr. Speaker, I yield myself such time as I may consume.

Mr. Speaker, I am bringing to the House a continuing resolution for fiscal year 2006. This CR runs through December 31. It is clean without exception. This CR will fund agencies in our last two remaining bills, the Labor-HHS and Defense bills, at the lowest level possible.

When we passed the last CR, my hope was that it would bring a strong motivation for Congress to complete its work in regular order. I want the body to know that the Committee on Appropriations has been strongly committed to bringing to this floor individual conference reports for each and every bill. The committee does not support an omnibus in any form and has done everything in its power to ensure that that did not happen.

The Appropriations Committee passed each bill of the 11 subcommittee bills off the House floor by June 30, the earliest that has been done in some 18 years. The Appropriations Committee has remained committed to moving these bills individually and within the framework of the budget resolution.

Mr. Speaker, the Appropriations Committee has kept its word. I am convinced that moving bills individually is the only way to get us back to regular order. Lacking regular order, there is a tendency for the remaining bills to become ``Christmas trees,'' if you will,

and for spending to grow out of control. In my view, that is simply not acceptable. I hope that, next year, we do not find ourselves in the position we are in today.

We are presently attempting to work with the Senate to finish a disaster assistance package that would be fully offset. It may include some avian flu preparedness money. Some have suggested that legislative language related to ANWR be included as well. This language has the potential, in my judgment, to sink the entire package once it reaches the Senate.

The underlying bill, the DOD appropriations bill, is the most important of our annual appropriations bills for it funds our national security. Agreements have been reached on all major issues in the DOD portion of the bill. Frankly, we could have passed this bill weeks ago. We are at war, we have troops in harm's way, and we still have not passed this critical legislation. There are funds in this bill to provide body armor for our troops, up-armored Humvees and a military pay raise. Failure to enact this bill in a timely fashion is a disservice to our men and women in uniform.

Mr. Speaker, I urge my colleagues to support this CR and would like to close my remarks by wishing all my friends on both sides of the aisle a Merry Christmas and a Happy New Year. It is great to be with you.

Mr. Speaker, to the chairman and to my colleague, Mr. Edwards, from beautiful downtown Texas, I want to congratulate both of them for this very fine piece of legislation. It reflects a great deal of the variety of mix that we needed to be able to focus upon in a very special way in the arena that involves not just veterans, certainly our veterans, but beyond that, the families of the men and women who serve us and ofttimes put their lives on the line, questions like their housing, other kinds of benefits that are very important to their being able to have decent lives while they serve us. Focusing on all those issues within one subcommittee, I think, is going to produce real results down the line. The bipartisan spirit that is a part of this committee, and we can see it reflected in the House today, is very much a part of that.

I would like to mention just one thing to my colleagues, an item that has been of concern to me for most of my career here. In the past, Mr. Speaker, I had the privilege of chairing the subcommittee that did the funding for our veterans. One of my concerns during those years was that ofttimes within the community that is Washington, DC, we expressed great support for our veterans, raised funds to try to improve the funding flows, and then did not do very much about following the money when it went down to the communities where veterans are served.

Particularly, I have been concerned over the years with the kind of treatment that ofttimes took place at the hospitals, and I have been urging the veterans service organizations to do more than be proud of the money that is appropriated here, but rather make sure that money is used in a quality way in terms of the service at the other end of the line.

We are beginning to do some things like involving clinics in rural areas where there are open spaces and the hospitals are not close by. All of that, I think, portends well for the future here.

But I would raise just one cautionary note: It is very important that we continue to put pressure on those organizations whose design and purpose is to support our veterans, to help us follow the money down to the local communities, make sure that it is being spent well. It is great to have increased dollar flows, but throwing money at problems is not always the solution. We all know that. So in this instance, I would say to my ranking member, Mr. Obey, as well as to the chairman and ranking member of the subcommittee, together we ought to form a partnership to make certain every one of those dollars is spent well on behalf of our veterans at the local community.

With that, congratulations on your work. It is a very fine product.

Mr. Speaker, Chairman Knollenberg, my colleague from Massachusetts (Mr. Olver) I rise simply to express my deepest appreciation for the work that you have been about on this newly organized subcommittee that has a variety, a mix, of complex issues that can conflict with each other, issues that if taken the wrong way, can cause bills to be stymied and no progress made. You have done a very, very fine job of establishing a tone that says that we can work together. And where Appropriations does its best work is when we reach across the aisle and recognize that while we do not have to agree 100 percent of the time, there is little doubt that a real solution comes when we do think about these alternatives, talking to one another as human beings and people who represent citizens across the country as well.

The bill is a very fine bill, a great job. I want to congratulate the staff, especially, as we have gone through this transition. They have done wonderful work. I congratulate the entire subcommittee.

Mr. Speaker, I rise in tribute to an outstanding member of the House Parliamentarian's office who is retiring today after nearly 30 years of service. Muftiah McCartin will be retiring from her position as Associate Parliamentarian. She will truly be missed.

Muftiah has been a part of this institution longer than most Members. She began her career with the Parliamentarian's office in 1976, 3 years before I came to the House. She started as a Clerk and worked her way up to one of the senior positions in the office. As a Clerk, she continued her education and eventually earned her law degree. She became the first woman to be appointed a Parliamentarian in 1991. Her story is truly one of personal and professional excellence, initiative, and dedication to her responsibilities.

Mr. Speaker, the Committee on Appropriations is particularly sad to see Muftiah leave. Her knowledge of parliamentary rules and precedents as they pertain to appropriations bills is unsurpassed, as is her knowledge of the budget process. The Committee has always had tremendous confidence in her skills and ability to proffer accurate advice. With numerous regular and supplemental appropriations bills coming to the House floor each year, the Committee relied on her expertise extensively. The words ``check with Muftiah'' were heard over and over again in the Committee's offices.

The Committee's high admiration of Muftiah's professional skills is matched by the Committee's appreciation of the calm and composed manner in which she performed her duties. She is always approachable and willing to take time to work on any matter, even when the other demands on her time are huge. She always approaches her work with a smile and keeps her sense of humor. In addition to the professional relationships she developed with the staff of the Committee, many highly valued personal friendships arose during her time with us.

Muftiah will now be able to spend more time with her family--her husband Terry, and her children Marissa, Elaine, Sandra, and Luke. She and her family have made a lot of sacrifices over the years. I hope that now she will have more time to attend her children's basketball, soccer, and baseball games as well as other family activities that are so important.

Mr. Speaker, on behalf of the Members and staff of the Committee on Appropriations, I

want to wish Muftiah well as she embarks on this next phase of her life's journey. I also genuinely thank her for all that she has done for the House and for the Committee, and I want her to know that she will be missed.

Madam Speaker, today I have introduced the Influenza Preparedness and Prevention Act, authorizing legislation that takes urgently needed steps towards preparing our Nation for the threat of pandemic flu. As an appropriator, I have rarely introduced authorizing legislation. It is something I have only done a handful of times in my career in the House, but I firmly believe this looming catastrophe calls for action.

In 1918, the Spanish flu killed 40 million people worldwide, and more died from the flu than through combat during World War I. Experts warn us that we are overdue for another pandemic flu outbreak. Although this avian flu

virus has not yet transferred from human to human, it looks and acts like the virus of 1918, more so than any other influenza outbreak in this century. Of the more than 100 people known to have contracted the virus in Asia, 50 percent have died.

If a pandemic flu hits our shores, all levels of government must work together if we are to avoid thousands of deaths. We in Congress must make sure the infrastructure and resources are in place to prepare for and combat a pandemic flu crisis.

The President has issued a call for action by a National Strategy on Pandemic Influenza. The key components of this strategy are international surveillance, domestic surveillance, vaccine development, stockpiling antivirals, communication, and State and local preparedness.

The legislation I have introduced today, the Influenza Preparedness and Prevention Act, supports and complements the administration's strategy. Most importantly, it sets us on a course to quickly develop and purchase vaccines and antivirals. For example, my bill calls for Health and Human Services to stockpile enough antivirals to treat 25 percent of the U.S. population. As the President has made clear, though, stockpiling is only a part of the strategy to combat a pandemic.

Vaccines are the ultimate defense against a pandemic. A vaccine developed by NIH shows early signs of promise for preventing the most dangerous strain of avian flu. My legislation calls on the Secretary of HHS to begin to stockpile doses of a viable vaccine. It also supports the continuing development by NIH of an effective vaccine and new technologies that will make it faster and easier to produce.

Madam Speaker, we do not have the vaccine manufacturing capacity in the United States to produce the doses we need to combat a pandemic. The number one barrier is more vaccine production, and to that production is the threat of lawsuits. We must have sensible liability reform as we search for a vaccine and build manufacturing capacity. My bill proposes limited liability protections for vaccine manufacturers and providers, with an exception to allow suits to proceed against companies who act with willful misconduct.

Education and communication are vital to prepare for a pandemic. The Centers For Disease Control and Prevention does fabulous work in public health education. My bill expands and supports their efforts to work with health providers and State and local health departments in this effort.

It is critical that we educate the public on both pandemic influenza and the garden variety flu we see every year. The more people become used to taking the annual flu vaccine, the easier it will be to get them in quickly for vaccinations in a pandemic. And the more business we provide for vaccine makers, the better our chances they will be ready to gear up for the kind of production that we will need to stop a new strain from reaching pandemic levels.

Of course, the way to stop the avian flu outbreak from becoming a pandemic is spotting it and containing it as soon as possible. The CDS is working across the globe to detect and identify the avian flu virus and is working with foreign health officials on strategies to prevent outbreaks. This bill will expand this critical program and create an assistance program for helping nations to combat avian flu.

The pandemic may never happen, but we cannot put American lives at risk by failing to prepare and make proper investments. This legislation is just the beginning of the commitment that I will make to head off this potential pandemic. As chairman of the Appropriations Committee, I vow we will respond to the administration's emergency supplemental request, and the pipelines will be filled to meet this challenge.

Mr. Speaker, I very much appreciate the chairman yielding me a brief amount of time. I am not rising actually to close, but rather to say to the body how much I believe both the ranking member and I very much appreciate the tone that has been set by the leadership of the gentlewoman from New York and the gentleman from Arizona.

The bill that was passed through our process last year, the bill this year reflects absolutely the best of our work in the Appropriations Committee on a bill that is perhaps as important as any of our subcommittee reports. This bill reflects our effort by way of both Houses to support foreign policy that in the long term reflects America's interest in the world.

There is absolutely no question that the assistance that goes forward with these bills and through this effort has a huge impact upon providing a positive slant to America's voice in the world. I could not feel more strongly than I do that foreign affairs should be handled in a nonpartisan way, and this bill is the first bill in my memory that had the signature of every member of the conference committee from both bodies, Democrat and Republican alike. It is incredible to see us move in the direction of actually have the House recognize how important foreign assistance is and foreign affairs is in terms of America's interest in this complex and shrinking world.

So congratulations is long overdue for the work of this very fine staff, but most important the leadership of Mrs. Lowey and the leadership of my friend, Jim Kolbe, making a real difference on behalf of this changing and complex circumstance that we are responsible to play a leading role in.

The President should recognize just how important this tool will be as he goes forward in trying to have our voice have the impact we must have in the world.

Mr. Speaker, it is my pleasure today to honor San Bernardino County Fire Marshall Peter Brierty, who has been recognized this month as a National Forestry Hero. I know from personal experience that this award is justly deserved, for Peter Brierty is widely regarded among my constituents as one of the heroes who saved thousands of people and their homes from the terrible fires of 2003 in the San Bernardino Mountains.

Many of my colleagues have heard me speak on the urgent need to get rid of millions of trees killed by a drought and insect attacks in and around the San Bernardino National Forest in my district. The fire danger from these trees jeopardizes the lives and homes of tens of thousands of people and homes that make this one of the most urbanized forests in the Nation.

One of the first people to understand the potential danger from this situation was Peter Brierty. More importantly, Peter Brierty realized the need to act quickly and bring the whole community together to reduce the danger and be ready to evacuate if fires struck. For most of the past three years, Fire Marshall Brierty has worked tirelessly, pushing his staff and other public officials to develop these plans. He has become a well-known figure at countless meetings with residents, convincing them of the need to cooperate to save lives and property.

Under Fire Marshall Brierty's direction, San Bernardino County launched an ambitious effort to eliminate dead and dying trees on private and public lands outside of the national forest. The operation he created has been highly praised by the Natural Resources Conservation Service, which has funded the effort, as extremely cost- efficient and effective.

But the danger was too great in 2003, and the ``Old Fire'' struck before we could even begin to cut enough trees to stop it. Nearly 70,000 people were in danger, but the plan devised by Fire Marshall Brierty and other county, state and federal officials safely evacuated all of them. Not one life was lost in the fire, even though 350 structures and more than 800,000 acres were ravaged by the blaze.

Mr. Speaker, many people have devoted countless hours and unlimited energy to reducing the fire danger and restoring the forest in the San Bernardino Mountains. The task is far from finished, but we have seen two fire seasons now in which no major blaze has threatened homes to the extent of the Old Fire.

In recognition of the role he played in confronting this threat to whole communities, Fire Marshall Peter Brierty was presented the 2005 National Forestry Heroism Award by the STIHL Incorporated this month. I would ask you and my colleagues to join me in congratulating him for this recognition, and thanking him for his unswerving devotion to public service.

Mr. Speaker, I come to the floor today to recognize the service of an outstanding leader in our Nation's Armed Forces. After more than 34 years in uniform, Rear Admiral Kathleen K. Paige will soon retire from the United States Navy and move on to private life.

Admiral Paige's sustained, superb service culminated in a series of highly challenging senior assignments where she demonstrated dedication to one primary goal: providing highly effective military capabilities to warfighters.

Her first Flag assignment was as Commander, Naval Surface Warfare Center in July 1996. Two years later, she assumed duties as Director, Theater Air and Missile Defense and Systems Engineering in the Program Executive Office for Theater Surface Combatants. Then, in April 1999, she was given the additional concurrent assignment as the first Assistant Secretary of the Navy (Research, Development & Acquisition) Chief Engineer--the Navy's senior technical authority for development of system and technical architectures. Because of her extraordinary talent and expertise in complex systems, in July 2001, the Missile Defense Agency selected her to be the first Ballistic Missile Defense System Technical Director in charge of integrating the engineering development of all the systems comprising the missile defense program.

Since August 2002, Admiral Paige has also served as the Navy's senior Engineering Duty Officer--nurturing the engineering community's rich heritage of scientific fact-finding and integrated, top-down engineering to ensure continuous innovation. At the same time, she made certain that the Navy remained anchored to fundamental operational realities.

Mr. Speaker, I would say to the gentleman from Texas (Mr. Barton), I appreciate the expeditious way he has responded to this crises. If there is a silver lining to the Hurricane Katrina crisis, it is that it has opened the eyes of Congress and our business community to the urgent need to add to the capacity of our oil refineries. The fact that gas prices shot up in the wake of this monstrous hurricane is a reflection of the reality that we do not have the capability to meet the sort of refining needs the country has that will put the kind of pressure on gas prices that are so important to our consuming public.

Hurricane Katrina is telling us very clearly that we have a challenge and an opportunity here to increase that capacity. In the last year, I met on several occasions with Adel Al-Jubeir, a representative of the country of Saudi Arabia. On any number of occasions he has rather smiled at me saying America does not have the capacity to provide the gasoline that your consuming public needs. You have not built a refinery in three generations.

We do have that opportunity by this action today, and I strongly urge the House to recognize it. This is the one chance for us to make a long-term commitment to reducing gasoline prices. I strongly urge an ``aye'' vote on this measure.

Mr. Speaker, I want to express my deep appreciation to both my chairman from Kentucky and the gentleman from Minnesota for the work they have done on this conference report.

At the beginning, as we brought Homeland Security together, we brought some 22 different agencies together under one maze. A very difficult process. Much of the original bureaucracies remaining in place and yet

struggling to figure out how and where and why they effectively work within the Federal Government. The chairman and ranking member have worked very hard to provide the kind of oversight that is necessary to lead them down this pathway, dealing with very tough issues that relate to America's national security.

Having said that, I want to congratulate the gentlemen for their work and at the same time suggest rather directly that none of us can do anything with that which an act of nature brings upon us. Katrina and Rita were natural disasters. We have not experienced such in my lifetime in public affairs. But, indeed, Americans are attempting as best they can to help the region of this country that is so important not only in terms of our natural resources but to our economy as well.

I very much appreciate the work particularly that was done by the gentlemen in overseeing that work which is the responsibility of the Coast Guard, for, indeed, they have gotten their attention. It is very apparent they are not just responding to the committee but in this very horrid crises did a great bit of response on behalf of America.

So I congratulate both of them for their work. I appreciate very much the job they have done.
